The federal appeals court has upheld a ban on deploying state troops in the Oregon city, following a latest court ruling.

Judicial Panel Concurs to Rehear Case

The federal appeals court ruled on Tuesday that it would rehear the case concerning the executive power with an larger group of eleven justices. The judicial body also vacated a earlier decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the most recent turn in a protracted legal battle over whether the administration has the authority and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the deployment effort was initiated in due to ongoing demonstrations.

Conflicting Arguments

The federal government has claimed that federal officials at the ICE facility in the southern part of the city were facing threats, while local authorities assert that local officers have command of the situation.

Contrary to descriptions of the city as “war ravaged”, locals have been sharing videos of lush hiking trails and a vibrant culinary culture, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in the city issued two temporary restraining orders this period – one blocking the federalization of the state troops, and another prohibiting the use of any national guard troops in the state, after efforts to evade the first order by mobilizing troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the physical sending of the troops.

The latest ruling means the issue will be heard by the full court – with both rulings under review together – by a panel of 11 judges.

“This ruling shows that the truth matters and that the courts are working to hold this administration accountable. The founding document limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” stated the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the armed forces into American urban areas without cause. We will continue defending Oregon’s laws, values, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
